Family and Partner Visas
Partner visas (subclasses 309/100, 820/801 & 300)
If you are in a genuine relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen, you may be eligible to apply for a Partner visa.
- If you are living in Australia, you can apply for the subclass 820/801 – Onshore Partner visa. The subclass 820 is a temporary visa granted first, followed by the subclass 801 permanent visa if the relationship is ongoing.
- If you are living outside Australia, you can apply for the subclass 309/100 – Offshore Partner visa. The subclass 309 is a temporary visa, and the subclass 100 is a permanent visa.
- The subclass 300 (Prospective Marriage) is a temporary visa. This visa allows you to enter Australia to marry your Australian partner. Once married, you can apply for an Onshore Partner visa.

Child visas (subclasses 802/101 & 445)
Subclass 101 and 802 visas are permanent residency visas for children of Australian citizens or permanent residents. The subclass 101 Child Visa allows children who are overseas to join their parents in Australia, while the subclass 802 Child Visa is for children already in Australia. Both visas require the child to be under 18, or if older, financially dependent on their parent, and they must not be married, engaged, or in a de facto relationship.
The subclass 445 Dependent Child visa is a temporary visa for children whose parent holds a temporary Partner visa. This visa allows the child to be included in the parent's permanent Partner visa application.
Orphan Relative visas (subclasses 837 & 117)
The Orphan Relative visas (subclasses 837 and 117) allow eligible children to live permanently in Australia with a relative when their parents are deceased, unable to care for them, or cannot be found. You may be eligible to apply for this visa if you:
- Are under 18 years old at the time of application
- Have parents who are deceased, permanently incapable of caring for you, or cannot be found
- Are sponsored by a close relative who is an Australian citizen, permanent resident, or eligible New Zealand citizen. Close relatives who can sponsor include:
- Brother or sister (including half-siblings or stepsiblings)
- Grandparent or step-grandparent
- Aunt or uncle, step-aunt or step-uncle
- Niece or nephew
Subclass 837 is for those already in Australia, while subclass 117 is for those applying from outside Australia.
Temporary Sponsored Parent Visa (subclass 870)
The Subclass 870 Temporary Sponsored Parent Visa allows parents of Australian citizens, permanent residents, or eligible New Zealand citizens to stay in Australia for up to 5 years at a time. You may be eligible to apply for this visa, if you:
- Are the parent (biological, adoptive, or stepparent) of the approved sponsor.
- Have enough money to support yourself while you are in Australia
- Intend to stay in Australia temporarily and comply with visa conditions.
- Meet the health and character requirements.
You may be eligible to be a sponsor for this visa, if you:
- Are an Australian citizen, permanent resident, or eligible New Zealand citizen.
- Are at least 18 years old and the biological, adoptive, or stepchild of the applicant.
- Can demonstrate the capacity to support the applicant during their stay in Australia.
